Determination Based on Credit is Real

The Equal Opportunity Commission has sued Kaplan Higher Education Corporation accusing it of discriminating again “black job applicants for the way it uses credit history in its hiring process”. Business Day New York Times December 22, 2010.

Several states, including “Hawaii, Washington and Illinois, have banned or severely limited the use of credit reports in hiring”. Unless credit worthiness is related some how to your job, this kind of inquiry is inappropriate and in some states illegal. We at Sunshine State Bankruptcy support state legislation here in Florida that would prevent discrimination against job applicants through the use of credit histories in the hiring process. Your credit history is not a good marker for responsibility in employment decisions.
